Terms and conditions
These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the kingdomempowered.com website - including any and all subdomains ("Website", “Site”), "Kingdom Empowered" mobile application ("Mobile Application") and any of their related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you" or "your") and Kingdom Empowered, LLC ("Kingdom Empowered", "we", "us" or "our"). By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Services. You acknowledge that this Agreement is a contract between you and Kingdom Empowered, LLC, even though it is electronic and is not physically signed by you, and it governs your use of the Services.
Information About You and Your Access of Services
All information we collect on or through Services is subject to our Privacy Policy. By using Services, you consent to all actions taken by us in compliance with the Privacy Policy.
Permitted and Unpermitted Use
You may use Services in accordance with these Terms for either your personal and non-commercial use or for the internal use of your non-profit religious organization. All rights not expressly granted to you are reserved by Kingdom Empowered. You agree you are not permitted and will not use Services as follows:
in any way that violates any federal, state, local, or international law or regulation;
for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise;
to impersonate or attempt to impersonate any company or person, including Kingdom Empowered or another Services user;
to engage in any other conduct which, as determined by us, may harm Kingdom Empowered or users of Services or expose them to liability;
in any manner that could disable, overburden, damage, or impair Kingdom Empowered or interfere with any other person’s use of Services;
use any robot, spider, or other automatic device, process, or means to access Services for any purpose, including monitoring or copying any of the material on Kingdom Empowered;
to introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful;
to attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Kingdom Empowered or any server, computer, or database connected to Kingdom Empowered;
to attack Kingdom Empowered via a denial-of-service attack or a distributed denial-of-service attack; and
otherwise attempt to interfere with the proper working of Kingdom Empowered.
You also agree that you will not send, knowingly receive, upload, download, use, or re-use any material which:
contains any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable;
promotes sexually explicit or pornographic material, violence, or discrimination on any basis, including that based on race, sex, religion, nationality, disability, sexual orientation, or age;
infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person;
violates the legal rights (including the rights of publicity and privacy) of others or contains any material that could give rise to any civil or criminal liability under laws or regulations;
promotes any illegal activity, or advocates, promotes, or assists any unlawful act;
involves commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising; and/or
gives the impression that the material emanates from or is endorsed by Kingdom Empowered or any other person or entity, if this is not the case.
User Contributions
Kingdom Empowered contains interactive features that allow users to post, submit, publish, display, or transmit to other users or other persons content or materials (collectively, “User Contributions”) on or through Kingdom Empowered. However, we do not undertake to review User Contributions or any other material before it is posted on or through Kingdom Empowered, and cannot ensure prompt removal of objectionable material after it has been posted. So, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party.
All User Contributions must comply with these Terms. By providing any User Contribution on or through Kingdom Empowered, you grant us and our service providers, and each of their and our respective licensees, successors, and assigns, the right to use, reproduce, modify, perform, display, license, distribute, and otherwise disclose to third parties any such material in order to offer Kingdom Empowered. You represent and warrant that you own or control all rights in and to the User Contributions and have the right to grant this license and that all of your User Contributions do and will comply with these Terms. We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of Kingdom Empowered.
Accounts and membership
If you create an account on Kingdom Empowered, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.
Billing and payments
You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Where Services are offered on a free trial basis, payment may be required after the free trial period ends, and not when you enter your billing details (which may be required prior to the commencement of the free trial period). Sensitive and private data exchange happens over a SSL secured communication channel and is encrypted and protected with digital signatures, and the Services are also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users. Scans for malware are performed on a regular basis for additional security and protection. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
Accuracy of information
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Services or Services is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information on the Services including, without limitation, pricing information, except as required by law. No specified update or refresh date applied on the Services should be taken to indicate that all information on the Services or Services has been modified or updated.
Links to other resources
Although the Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Services. Your linking to any other off-site resources is at your own risk.
Monitoring and Enforcement; Legal Compliance; Termination
You agree that we have the right to:
take any action with respect to any user, Member account, or User Contribution that we deem necessary or appropriate in our sole discretion if we believe there to be a violation of these Terms, infringement of third party rights, a threat to the personal safety of others, or a threat, liability, or harm to the goodwill associated with Kingdom Empowered;
take appropriate action, including without limitation, referral to law enforcement and disclosure of your information, for any illegal or unauthorized use of Kingdom Empowered; and/or
terminate or suspend your access to all or part of Kingdom Empowered for any or no reason, including without limitation, any violation of these Terms.
Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through Kingdom Empowered. YOU WAIVE AND HOLD HARMLESS KINGDOM EMPOWERED AND ITS LICENSEES AND SERVICE PROVIDERS AND ALL OF THEIR EMPLOYEES, OFFICERS, AND DIRECTORS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF LEGAL INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER KINGDOM EMPOWERED OR LAW ENFORCEMENT AUTHORITIES.
Limitation on Liability
IN NO EVENT WILL KINGDOM EMPOWERED, ITS LICENSORS, SERVICE PROVIDERS, OR ANY OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, KINGDOM EMPOWERED, ANY WEBSITES LINKED TO IT, ANY CONTENT OFFERED ON OR THROUGH KINGDOM EMPOWERED, OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH KINGDOM EMPOWERED, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Indemnification
You agree to indemnify and hold Kingdom Empowered LLC and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Services or any willful misconduct on your part.
Disclaimer of Warranties
YOUR USE OF KINGDOM EMPOWERED, ITS CONTENT, AND ANY FUNCTIONALITY, SERVICES, OR ITEMS OBTAINED THROUGH KINGDOM EMPOWERED IS AT YOUR OWN RISK, ALL OF WHICH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER KINGDOM EMPOWERED NOR ANY PERSON ASSOCIATED WITH KINGDOM EMPOWERED MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF KINGDOM EMPOWERED. WITHOUT LIMITING THE FOREGOING, NEITHER KINGDOM EMPOWEREDNOR ANYONE ASSOCIATED WITH KINGDOM EMPOWERED REPRESENTS OR WARRANTS THAT KINGDOM EMPOWERED OR ANY FUNCTIONALITY CONTENT OR ANY SERVICES OR ITEMS OBTAINED THROUGH KINGDOM EMPOWERED WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT KINGDOM EMPOWERED OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT KINGDOM EMPOWERED OR ANY SERVICES OR ITEMS OBTAINED THROUGH KINGDOM EMPOWERED WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
KINGDOM EMPOWERED HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
No Class Actions
You agree that you will only be permitted to bring claims against Kingdom Empowered on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. Unless both you and we agree otherwise, the dispute resolution decider (e.g., judge or arbitrator) of any such claim may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding. In addition, such dispute resolution decider may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party's individual claim(s). Any relief awarded cannot affect other Users.
Governing Law
These Terms of Use shall be governed by, construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania of the United States of America, as it is applied to agreements entered into and to be performed entirely within the United States and without giving effect to any principles of conflict of laws. You agree that any legal lawsuit or other action brought by Kingdom Empowered, you or any third party to enforce these Terms of Use, or in connection with any matters related to the Site, shall be subject only to the jurisdiction of the courts located in the Commonwealth of Pennsylvania of the United States. Kingdom Empowered makes no representations that the Site operate (or are legally permitted to operate) in all geographic areas, or that the Site, or information, services or products offered through the Site are appropriate or available for use in other locations. Accessing the Site from territories where the Site, or any content or functionality of the Site or portions thereof, including but not limited to functionality discussed in the Privacy Policy, is illegal is expressly prohibited. If you choose to access the Site, you agree and acknowledge that you do so on your own initiative and at your own risk and that you are solely responsible for compliance with all applicable laws.
In the event that one or more terms of these Terms of Use becomes or is declared to be illegal or otherwise unenforceable by any court of competent jurisdiction, each such term shall be null and void and shall be deemed deleted from these Terms of Use. All remaining terms of these Terms of Use shall remain in full force and effect. Kingdom Empowered shall have no liability under these Terms of Use to the extent arising from any failure of Kingdom Empowered to perform any of its obligations under these Terms of Use due to any fire, flood, earthquakes, other acts of God, war, civil unrest, terrorism, Internet failures, governmental act or court order, national emergency, strikes or labor disputes or any other event beyond Kingdom Empowered’s reasonable control. Kingdom Empowered shall not be responsible for damage or other problems caused by any unauthorized change to these Terms of Use made by way of hacking or cracking this page.
Changes and amendments
We reserve the right to modify this Agreement or its terms relating to the Services at any time, effective upon posting of an updated version of this Agreement on the Services. When we do, we will revise the updated date at the bottom of this page. Continued use of the Services after any such changes shall constitute your consent to such changes.
Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Services.
